Background
Washington State University (WSU) hires contractors to perform public works construction projects. If asbestos abatement is needed for the project, it is either performed in house prior to bidding the project, or is included as part of the project. If asbestos abatement is part of the overall project, the general contractor will be required to hire an asbestos abatement subcontractor to perform the abatement work prior to initiating the construction portion of the project. If an asbestos abatement contractor is hired as a subcontractor to a general contractor on a public works project, an independent third party will be hired to oversee asbestos abatement activities associated with the project.
Capital Planning and Development Projects
In Capital Planning and Development (CPD) projects, WSU, represented by the Project Officer, hires the third party overseer. This third party overseer performs, as a minimum, the tasks indicated below. Additional tasks may be required as deemed necessary by the Project Officer. The Project Officer, as an alternative, may hire a qualified WSU staff to perform third party oversight functions.
Facilities Operations Projects
Facilities Operations (FO) also performs public works projects. For FO projects, the third party oversight is selected and hired by Environmental Health and Safety (EH&S). The third party overseer performs, as a minimum, the tasks indicated below. Additional tasks may be performed as deemed necessary by the EH&S. EH&S, as an alternative, may hire a qualified WSU staff to perform third party oversight functions. The third party overseer coordinates clearance conditions with the FO project officer (architect, engineer, project leader or construction supervisor) or construction coordinator.
Part 1: Requirements and Responsibilities of Persons Performing
Third Party Oversight for Washington State University
ProjectsAny person performing third party oversight for asbestos abatement projects at Washington State University (WSU) must:
Additionally, the person performing third party oversight must also have one of the following certifications:
- be accredited by EPA as an asbestos building inspector
- be approved by the WSU Environmental Health and Safety (EH&S) department
- A State of Washington certified asbestos supervisor, or
- An EPA accredited Project Designer
Any person performing third party oversight at WSU must perform the oversight duties in compliance with EPA and Washington State Department of Labor and Industry (L&I) rules, as specified in WAC 296-62-077 to 07755.
The person performing third party oversight is responsible for four primary tasks:
- Taking pre-abatement samples in the abatement area (this may be accomplished on site with a certified NIOSH 582 analyst, if pre-approved by EH&S)
- Taking post-abatement samples in the abatement area (this may be accomplished on site with a certified NIOSH 582 analyst, if pre-approved by EH&S)
- Inspecting the abatement area for contractor compliance to asbestos regulations and to WSU's contract specifications.
- Preparing a final report which includes clearance information for the abatement project, compliance information from observation of the contractor's activities, and certification that complete abatement of subject ACM and/or PACM occurred and remaining surfaces and/or replaced materials do not contain asbestos.
After clearance sample analytical reports have been received, the overseer inspects the abatement site to ensure no visible emissions remain. Then, if no visible emissions are present, and if clearance samples meet WAC 296-62-07709(3)(h) requirements and WSU specification requirements, the overseer reports to the CPD or FO Project Officer that clearance conditions are met. Upon approval of the Project Officer, the area is cleared and the regulated area may be decommissioned and containment, if applicable, may be removed.
The final report must be written and must include a map or maps of rooms and/or areas showing the location where abatement occurred. The report must include a description of the materials removed, and indicate the amount of material removed.
The final report must contain a list of any infractions of the asbestos rules noted. It must also contain a list of infractions of the WSU specifications noted.
The final report must contain the disposal log for asbestos materials removed from the project.
The final report must be in a typewritten or printed form, with the information legible and clear.
